Terms of Service

These Terms of Service ("Terms") govern your access to and use of WebCabin (the "Service"), operated by Koalatech Pte. Ltd. ("Koalatech", "we", "us", or "our"), a company registered in Singapore. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

WebCabin is an AI marketing platform that lets you build landing pages, generate copy and ad creatives, capture leads, view analytics, connect advertising accounts such as Meta Ads, and use related marketing tools and features. We may add, change, or remove features over time.

2. Accounts

You must provide accurate information and be at least 18 years old to use the Service. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly of any unauthorized use.

3. Subscriptions, billing, and trials

The Service is offered on a subscription basis. Fees, billing cycles, and any free trial terms are presented at sign-up. Subscriptions renew automatically until cancelled.

• Payments are processed by our payment provider, Stripe.
• You authorize us to charge your payment method for recurring fees.
• You may cancel at any time; cancellation takes effect at the end of the current billing period.
• Except where required by law, fees are non-refundable.

4. Acceptable use

You agree not to use the Service to:

• Violate any law or third-party rights, including intellectual property and privacy rights
• Publish content that is unlawful, deceptive, fraudulent, or harmful
• Collect sensitive personal data through forms in violation of our policies or applicable law
• Distribute malware, spam, or attempt to disrupt or gain unauthorized access to the Service
• Misuse the AI features to generate prohibited, infringing, or misleading material

5. Your content

You retain ownership of the content you create or upload ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to operate and provide the Service. You are responsible for Your Content and for ensuring you have the rights to use it.

6. Third-party integrations and advertising

The Service integrates with third-party platforms, including Meta (Facebook and Instagram). Your use of those integrations is also subject to the third party's own terms and policies.

You are solely responsible for your advertising activity and for ensuring your ads, landing pages, and data collection comply with all applicable laws and the policies of the relevant advertising platform. WebCabin provides compliance checks as a convenience, but you remain responsible for what you publish and spend. We are not liable for advertising spend, account actions, or decisions made by third-party platforms.

7. AI-generated output

The Service uses AI to generate text, images, and other output. AI output may be inaccurate or unsuitable for your purpose. You are responsible for reviewing and verifying any output before relying on or publishing it. We make no warranty that AI output is accurate, original, or fit for a particular purpose.

8. Intellectual property

The Service, including its software, design, and branding, is owned by Koalatech and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding except as needed to use the Service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Koalatech and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Koalatech from any claims, damages, or expenses arising out of Your Content, your use of the Service, your advertising activity, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that creates legal or security risk. Upon termination, your right to use the Service ends, and we may delete Your Content in accordance with our Privacy Policy.

13. Governing law

These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles. The courts of Singapore will have exclusive jurisdiction over any dispute arising from these Terms or the Service.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide additional notice where appropriate. Continued use of the Service after changes take effect constitutes acceptance.
